How to transfer ownership of program code / proprietary software?

Posted by admin in 6 on 11 28th, 2009

Is there a template for a valid contract to transfer the ownership, development rights, and all other rights of a software from the developer to another person? Does anyone have a pdf, doc, or a link to a good and sound contract for especially this purpose?

Again, I am not talking about a bought copy of a software here. I am talking about how the developer / programmer of software X can transfer all the rights to the software he developed to another person.

Here is a well written web development contract that minimizes the use of legal jargon, but is nevertheless very thorough. I used it as a reference when creating my own contract template. Refer to the link in the source section. When visiting their website, it is the Contract for Web Development that you are interested in.

Whereas you may not be developing a website, the following clause may be of use if modified for your specific situation:

38. Ownership to Web Pages and Graphics.

Copyright to the finished assembled work of web pages produced by the Developer and graphics shall be vested with the Client upon final payment for the project. This ownership is to include, design, photos, graphics, source code, work-up files, text, and any program(s) specifically designed or purchased on behalf of the Client for completion of this project.

All materials developed under this contract and intended for publication to the web remain the property of Developer until such time as final payment for the work described herein has been tendered by Client. At this time, all materials become the property of Client and may be used by them, as desired.

Should materials described in this contract be used on the web by Client before the tender of final payment, then this contract is breached and appropriate penalties will
apply.

What is the best professional tax software to use?

Posted by admin in 6 on 11 26th, 2009

I have done taxes for the past 2 years, however I have worked for H&R Block. I have prepared taxes seperately but just used the free online software. I am now opening my own mobile tax service and would like to know which professional software is the best and inexpensive? I have looked up Drake and others but everything is about $1000 i was hoping to spend about $200-$400 on the software. Can someone out there please help me find the best software for my budget.

H/R has a program on the shelves called
2nd Story Software also has one called Tax Act, I have used both and prefer this one
the other major ones, ie Drake etc are quite expensive but very good, if you have a lot of clients and need help, they are excellent in response

What is the most popular radio production software?

Posted by admin in 6 on 11 24th, 2009

I am starting a radio production course this year and I want to get some experience using the software that is used in radio stations for cueing the music and ads, and for talk over etc.

Anyone have any ideas what the most popular software is?

You need to visit a radio station because your idea of what is used in broadcasting is about as far from reality as it can get.

Radio stations have used basically the same equipment for 50 years or more… a MIXING BOARD, turn tables, tape record and playback decks and a whole assortment of audio sweetning EQUIPMENT.. they aren’t doing it at home on their PC… they are using, in some cases, State of the Art recording equipment… but at the other end of the scale.. out in the midwest… they don’t even have the basics, since their programming comes in by satellite.

What is pricing structure for commercial real estate brokers?

Posted by admin in 3 on 11 24th, 2009

Is there a range of commissions or fees most commercial real estate brokers use? For example residential real estate varies but is between 5-7% depending upon the area of the country.

Could someone provide a rough outline of commercial real estate broker pricing?

In CA the standard commission is 10%. I would assume elsewhere it is about the same, but I do not know for sure.

What software automatically generates a list of all books written by an author?

Posted by admin in 6 on 11 21st, 2009

I’m looking for a software that let me input the list of books I have[Author - Title], generates a list of all books written by the author and diffrentiates between the books I have and the ones I don’t. The software I’ve seen only lets me work with books that I have and doesn’t list out books that I don’t have by the same author.

ummm….i’d say amazon.com your author and look at the list of books

then, maybe only capitalize the names of books you have and dont capitalize the names of books you dont…or some other way of differentiating them

that way, u can keep using the same software you’re using

Can anyone suggest marketing ideas for restaurants, cafes and bars/clubs?

Posted by admin in 4 on 11 13th, 2009

I am looking for best ways for marketing a restaurant, cafe and bar.
So far, what I have thought of was only the typical most common ways like, ‘business card in a fish bowl’, advertising, etc…but want to be more creative and effective.

Can anyone share any ideas for me to use?

Thanks in advance. :-)
The best marketing strategy now lies in social marketing…building your brand. Twitter, Facebook, video, LinkedIn, etc.

Nothing is less expensive, yet so far reaching. You can do it yourself or freelance it out to a Virtual Assistant.

Either way, it’s a solid opportunity to let people know that you’re out there.

What software to use to make a magazine cover?

Posted by admin in 6 on 11 4th, 2009

I want to experiement with software to make a magazine cover. Any software thats good at that kind of stuff? Thanks!

Photoshop and Gimp are graphics editing/enhancing applications.
They are not intended for page layouts.
Microsoft Publisher and Adobe InDesign are desktop publishing applications which can be used to create things such as posters, flyers, brochures, magazines and books.
Not sure if free trials are available for either.
Neither is free so purchase is required for continued use.

PagePlus SE is a free desktop publishing app. I use it for quick designs and layouts on my laptop due to it’s smaller size on disk.

Any funny marketing ideas for a usb gadgets store?

Posted by admin in 4 on 11 4th, 2009

I have an online usb gadgets store and I would like to promote it in a funny way… any interesting ideas?

Think "Honda Advert", maybe make a video with a chain of things happening.

How about a war with USB missiles, landing in USB fishtanks, USB warmed coffee cups, and as many other things in it as you can, and have the name either in credits, or get it in some other way.

If it’s a fun vid, then people may pass it around, link to it and so on.

What will motivate a real estate agent to maximise the buyer’s interest?

Posted by admin in 3 on 11 4th, 2009

Current commission structure in Singapore (based on sale/rental value) provides no motivation for a real estate agent to maximise the interest of the buyer. This is because higher the sales/rental value higher will be his/her commission. What can we do to change this?

We had a similar system in the U.S. Agents were representatives of the sellers and were required by law to support their interests. Now we have a system whereby agents can be trained and qualified to work as buyer’s agents.

The new system allows agents to represent the buyer on all listings other than his own. The agent only earns a commission when he sells, but is no longer motivated to sell only his own listings. At the same time, the buyer signs an agreement stating that he will work solely with that agent to find a dwelling unit for the term of the agreement.
